Key Lease Terms

Lease Duration

All leases commence upon signing and run through December 31, 2030 (5 years). Both parties are obligated to fulfill the entire length of the lease.

Payment Terms

  • Rent is calculated on a per dryland acre basis using FSA measurements
  • First full payment due upon signing
  • Annual payments due February 1st of each subsequent year
  • 10-day grace period for each payment
  • Late payment penalty: 5% of annual payment if not paid within grace period

Tenant Responsibilities

  • All dryland expenses (except real estate taxes and landlord’s portion of noxious weed expense)
  • Good weed control program, including noxious weeds and wild rye
  • Farm operations conducted according to good husbandry practices
  • Compliance with FSA and NRCS regulations
  • Maintaining farm in good condition
  • Providing production records to FSA by December 31st annually
  • Comprehensive public liability insurance to THE Farm
    covering both Landlord and Tenant under limits of liability of not less than one million dollars
    per occurrence.

Landlord Responsibilities

  • Payment of real estate taxes
  • 50% reimbursement for chemical spot spraying of noxious weeds
  • Fire and hazard insurance for fixtures
  • Comprehensive public liability insurance ($1M minimum)

Government Programs

Tenant receives all crops harvested and is entitled to 100% of government payments for the farm. It is the tenant’s sole responsibility to properly and timely sign up for government program payments at the FSA office in Julesburg, Colorado.

Reserved Rights

  • Hunting Rights: Tenant possesses all hunting rights
  • Wind & Solar Rights: Landlord reserves all wind and solar rights
  • Mineral Rights: Landlord reserves all oil, gas, gravel, and mineral rights
  • Carbon Credits: Any carbon credits require pre-approval; proceeds divided equally minus expenses

Farming Restrictions

  • No stubbleback or continuous wheat crops
  • Spring crops allowed except wheat and rye
  • No growing or carryover crop allowed at lease termination
  • Cover crops in final year require pre-approval for reimbursement consideration

Insurance Requirements

Creditworthiness

Creditworthiness is the main factor for lease agreement consideration.

  • Landlord may require credit references at any time during the lease
  • Tenant must provide written credit references within 10 days of request
  • References from primary financial institution and business entities required
  • Letters of reference may be requested prior to signing lease agreement
  • Refusal to provide credit references may be treated as breach of lease


Chemical Application History

Payment Schedule

  • Full annual payment due upon signing
  • Subsequent payments due February 1st each year
  • Insurance certificates due upon initial signing and annually upon renewal date.
  • 10-day grace period for payments
  • 5% late penalty if not paid within grace period
  • Lease may be terminated if payment remains unpaid for 30+ days

Reimbursement for Final Year Expenses

  • Landlord will consider reimbursement to Tenant for
    fall expenses reasonably incurred in the final year of the lease.

Right of Entry

Tenant agrees to allow Landlord or its representative access to the farm at any reasonable time for:

  • Property inspection
  • Checking on noxious weeds
  • Application of fertilizer, herbicides, or insecticides
  • Ensuring compliance with lease terms
